Dilapidation

A Schedule of Dilapidations survey sets out items of disrepair where the tenant has failed to comply with the repairing clauses of the Lease, and also the works required to put the property back into repair.

If you have an interest in a leasehold property, it is essential to have an understanding of the obligations placed on either the landlord or tenant under the lease for its maintenance. Understanding these obligations is essential prior to entering into any agreement as mistakes could be costly.

Dilapidated rooms

We can act for either the landlord or tenant to prepare a schedule of dilapidations (landlord) or defend a claim for dilapidations issued to a tenant. We can also provide advice prior to commencement of a lease, commenting on future liabilities the lease would impose on a tenant.

Tenants considering changes to their leased property should be aware that they may need to seek the landlord’s approval via a licence for alteration agreement. At Latitude we are able to provide the necessary advice and prepare the relevant information that would be required by the landlord for approval.
